These Terms of Use (“Terms of Use”) govern your use of our Site (defined below) operated by TotalCardiology Rehabilitation Inc. or its affiliates.  Anyone who wishes to use our Site accepts these Terms of Use without change.  By accessing our site, you are indicating your acknowledgment and acceptance of these terms of us and all policies relating to this site.

Definitions:
“Content” is defined in Use of Content section.
“Site” means this TotalCardiology website.
“TotalCardiology”, “we” or “us” means TotalCardiology Rehabilitation Inc. or its affiliates.
“You” means a user of the Site and any Content.

Use of Content / Disclaimer
This Site does not provide medical advice to users.  The information on the Site is provided for general informational purposes only, solely for your personal, non-commercial use, and is not a substitute for professional medical advice, diagnosis or treatment by a qualified physician or health care professional.

Ownership of Content
TotalCardiology, its licensors and service providers may make available certain content, including information sheets, text, data, graphics, photos, and other content (“Content”). The Content is protected under Canadian copyright and intellectual property. The Content materials may be owned us or by other content providers.

Online Booking Service
For physicians and clinics eligible to use TotalCardiology's Online Booking Service, you must apply using the registration form and you must be registered to use this service.  It is a condition of your use of the Online Booking Service that you provide correct, current and complete registration.  If registered, you are responsible for maintaining the confidentiality of your login information and password.  You represent that you have the necessary permissions to supply the information (including any health information) that you input into the booking system.  You are responsible for all uses of your account.

Privacy Policies
All of the personal information submitted by users through our Site (if any) is governed by our Privacy Policies. TotalCardiology’s Privacy Policies describe TotalCardiology’s personal information handling policies and practices in detail, as such policies may be amended from time to time by TotalCardiology. TotalCardiology advises you to check the Privacy Policies on a frequent basis for changes.

Communications and Security Acknowledgement
You acknowledge that TotalCardiology cannot guarantee the security of information communicated by email or the internet.  While we implement industry-standard security protocols, use of the internet is subject to security flaws and risks.  You accept those risks by using the Site or any services through our Site. By providing your email address in connection with registration as a User, you consent the TotalCardiology Group using commercial electronic messages to communicate with you about the Site.

You understand that TotalCardiology cannot and does not guarantee or warrant that the Site or any Content available for access or download will be free of viruses, or other harmful code. You are responsible for implementing sufficient procedures and checkpoints to satisfy your particular requirements for accuracy of data input and output. TotalCardiology does not assume any responsibility or risk for your use of the Internet. TotalCardiology does not represent or warrant that the content, the Site, its servers or email sent from the Site are free from viruses or other harmful components.

Limitation of Liability
Your use of this site and the content is at your own risk. Except as may otherwise expressly be provided on the site, everything on the site including the content, is provided “as is” and “as available” without representations, warranties, guarantees or conditions of any kind, either express or implied. Except as may otherwise expressly be provided on the site, TotalCardiology expressly disclaims any and all liability for injury or other damages which may be directly or indirectly associated with the content contained in the site, and disclaims all representations, warranties, guarantees and conditions, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement of those arising out of a course of dealing or usage of trade.

The total liability of TotalCardiology, whether under the express or implied terms of this agreement, in tort (including negligence or other duty of care) or at common law, for any loss or damage including but not limited to medical injury, personal injury, wrongful death, improper diagnosis, inaccurate information, improper treatment  or any other loss incurrent in connection with your use, misuse, modification of, or reliance upon, whether suffered by you or third parties, whether direct, indirect or special, or any other similar damage that may arise or does arise from the site, or any breach of this agreement by TotalCardiology, is limited to the amount of the fee (if any) paid to TotalCardiology by you for access to the site, or the amount of $50, whichever is greater.

Applicable Law
These Terms of Use and any action related thereto or related to the Site and the content will be governed, controlled, interpreted and defined by and under the laws of the Province of Alberta and the federal laws applicable therein without giving effect to any principles of conflicts of laws. You agree that any action at law or in equity arising out of or relating to these Terms of Use or your use of the Site and the content will be filed only in a court located in Calgary, Alberta, Canada.

General
The Site may be down or interrupted from time to time due to maintenance or technical failures. TotalCardiology assumes no liability for any downtime, delay, or interruption related to the Site.

This Site may contain links to other sites which are not maintained by, or related to, TotalCardiology. Hyperlinks to such sites are provided solely as a convenience to you and do not imply any endorsement by TotalCardiology of, any affiliation with or endorsement by the owner of the linked site. TotalCardiology has no control over such third-party sites.

These Terms of Use and any other legal notices, legal terms, policies and guidelines of TotalCardiology linked to these Terms of Use or otherwise made available to you in connection with the Site or any services available through the Site constitute the entire agreement between you and TotalCardiology relating to the subject matter hereof. You may not assign, convey, subcontract or delegate your rights, duties, or obligations hereunder. TotalCardiology may assign this agreement in the course of a corporate reorganization, merger or acquisition on notice to you. If any provision of the Terms of Use is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavour to give effect to the parties’ intentions as reflected in the provision, and the other provisions of the Terms of Use remain in full force and effect. Not all functionality is available in the beta phase, and some functionality may be introduced over time.

It is the express will of the parties that this agreement and all related documents be drawn up in English. C'est la volonté expresse des parties que la présente convention ainsi que les documents qui s'y rattachent soient rédigés en anglais.
